General Terms and Conditions

2. Registration

Registration in writing, verbally or online via the MINDBODY online booking system is binding. It entitles the customer to use the defined course offer against payment of the course price.

3. Cancellation Policy

Cancellations can be made in writing, verbally or online.

Sessions:
If the client is prevented from attending due to illness, holiday or other reasons, booked sessions must be cancelled by the client at least 24 hours before the appointment, otherwise the full amount is owed.

Workshops:
In the event of the client being prevented from attending due to illness, holiday or other reasons, booked workshops must be cancelled by the client at least six weeks in advance. In case of cancellation four to six weeks before the date, 50% of the course fee(s) are owed and an administration fee of CHF 50.00 will be charged. If the cancellation is made later than four weeks before the date, 100% of the course fee(s) are owed.

4. Validity & Reimbursement

• Individual sessions are valid for 1 month from the date of purchase.
• Packages of 5 sessions are valid for 2 months from the date of the first visit.
• Packages of 10 sessions are valid for 3 months from the date of the first visit.

Purchased individual sessions and subscriptions are personal and non-transferable. Vouchers are excluded from this. Sessions that have been paid for but not used or only partially used expire after their period of validity. There is no entitlement to a refund. In the event of illness, accident or pregnancy, ongoing subscriptions may be interrupted for the duration of the absence. The illness/accident/pregnancy must be notified immediately in writing. In any case, a medical certificate must be submitted.

5. Group Sessions

Semi-Privates:
If there is only one registration for a booked semi-privates session, the client concerned will be informed in good time. If the registered client still wishes to take the session, the rate for a private session will apply, otherwise the session will be cancelled.

Classes:
The minimum number of participants for Exclusive Mat Classes is three. If fewer than three participants are registered, in2motion zurich GmbH reserves the right to cancel the class.

6. Terms of Payment

• Individual sessions must be paid for at least 24 hours before the appointment.
• Packages are due for payment on the 1st day the package is used.

The client shall be in default without reminder if payment is not made as agreed. If payment is overdue by more than one month or if the terms of the contract are disregarded, the total amount of the contract shall become due for payment. All expenses incurred in connection with the collection of overdue receivables shall be paid by the client.

6. Liability

To the extent permitted by law, in2motion zurich GmbH excludes any liability for itself as well as for its staff. in2motion zurich GmbH accepts no liability for loss of or damage to clients’ personal belongings. All trainers have a professional liability insurance.

8. Use

in2motion zurich GmbH makes the facilities of the Pilates studio available to its customers during the respective course. Use is at the client’s own risk and is limited to the duration of the course. The client undertakes to use all the facilities made available to him/her, in particular Pilates equipment and aids, properly and carefully. The non-use of individual facilities does not entitle the client to a refund of the course fee. In the event of closure of the studio for operational reasons or cancellations of up to two weeks, which are not the responsibility of in2motion zurich GmbH (force majeure), the customer has no right to compensation. If the closure lasts longer than two weeks, the validity of the pricing options are automatically extended by the closure period that exceeds the two weeks.

9. Data Protection

All data required for business transactions are stored in compliance with data protection regulations. in2motion zurich GmbH treats your data confidentially and undertakes not to disclose your data in any way to unauthorised third parties and to protect it from any unauthorised access. in2motion zurich GmbH uses MINDBODY as an administration programme. Provider is MINDBODY, Inc., 4051 Broad Street Suite 220, San Luis Obispo, CA 93401 USA. When you attend a session or workshop or set up a customer account on our website or app, your data is stored on MINDBODY’s servers. The processing of the entered data is based exclusively on your consent (Art. 6 para. 1 lit. a DSGVO). You can revoke your consent to the storage of data at any time. If you wish to be informed by newsletter via email, your email address will be stored for this purpose. The newsletter is sent using the dispatch service provider ‘MailChimp’, a newsletter dispatch platform of the US provider Rocket Science Group, LLC, 675 Ponce De Leon Ave NE #5000, Atlanta, GA 30308, USA. This newsletter is free of charge and can be cancelled at any time.

10. Health Status

The client confirms sufficient mental and physical health to participate in the training.

11. Applicable Law

Swiss law shall apply.
